Benefits of Bankruptcy

When bankruptcy is the right option for you, it provides a number of benefits including:

Bankruptcy Chapters

Chapter 7
Chapter 7 bankruptcy is a liquidation bankruptcy for individuals and businesses. Under Chapter 7 of the Bankruptcy Code, a trustee is appointed to examine and direct the financial affairs of the debtor. All non-exempt property is sold and the proceeds are distributed to creditors. Exempt assets are retained by the debtor. Any remaining debt is “discharged”, or forgiven, giving the debtor an opportunity for a fresh start.

Chapter 13
Chapter 13 bankruptcy allows you to reorganize your debt and keep your home, car, and other valuable assets. It is designed for individuals with a regular income to catch up on their payments over a three to five year period. Chapter 13 is also typically suited for individuals who own a home and want to stay in their home.

Chapter 11
Chapter 11 bankruptcy usually results in reorganization of the debtor’s business or personal assets and debts, but can also be used for liquidation. It is primarily used by businesses but is also available to individuals, especially those who have substantial debts and do not qualify for a Chapter 13 bankruptcy. In most cases the bankruptcy filer acts as trustee and remains in control of its business operations.
